Obama Fires an Army Officer For Being Gay

I suppose it is not really fair to say that Obama specifically fired him, but it is fair to say that Obama allowed it to happen.

Dan Choi is a West Point graduate and an officer in the Army National Guard. He is fluent in Arabic and just returned from Iraq. Now he is going to be fired because he admitted that he is gay.

I am not bringing this up to make a point in favor or against the "don't ask, don't tell" policy. I am just bringing it to contrast the different treatment between Carrie Prejean (Miss California) and Obama; both supporters of traditional marriage. Carrie Prejean, who does not have any power to change policy, has been on the receiving end of vicious attacks because she has the 'audacity' of stating her true opinion. She said she did not want to insult anyone, and then gave her honest answer. An answer that according to recent polling is supported by the majority of Americans (though in fairness not by a wide margin). Obama, who has the power to effect and change policy, has been basically given a free pass.

"A new study, about to be published by a group of experts in military law, shows that President Obama does, in fact, have statutory, stroke-of-the-pen authority to suspend gay discharges. Obama could simply invoke his authority under federal law (10 U.S.C. §12305) to retain any member of the military he believes is essential to national security.

Or he could take advantage of a legal loophole. The "don't ask, don't tell" law requires the military to fire anyone found to be gay or lesbian. But there is nothing requiring the military to make such a finding. The president can order the military to stop investigating service members' sexuality.

An executive order would not get rid of the "don't ask, don't tell" law, but would take the critical step of suspending its implementation, hence rendering it effectively dead.
