2011 Comes to a End
As New York prepares to usher in 2012, I hope your 2011 was more interesting then your 2010, 2009 and 2008. As I have encouraged for the last few years; think about what you have done this past year and what you might have have done differently, not to live in regret but as a guide for the coming year. As the year comes to a close, so does any chance you had to live it to the fullest. If your lucky you will have the full coming year to try again. Stop putting off what you really want to do, because you never know when your luck will run out.

Nelson (D) to Retire
That Senate majority for the Republicans is looking more and more likely.

Democratic Sen. Ben Nelson of Nebraska will announce today that he is retiring after two terms, a serious blow to Democratic efforts to hold onto their majority in the chamber next November.
Nelson is scheduled to hold a press conference back home in Nebraska as early as today to make his decision official, said several Democratic insiders close to the leadership. …
The White House and top Senate Democrats, including Majority Leader Harry Reid (Nev.) and Sen. Chuck Schumer (N.Y.), had quietly mounted a pressure campaign to keep Nelson from retiring. Nelson has more than $3 million in his campaign war chest, and his approval rating solidified after falling over the last several years.
But with Nelson stepping down, the Democrats’ hold on the Senate is in serious doubt, although Democratic leaders believe they can still do so. Republicans are expected to pick up control of the Cornhusker State seat, although popular former Sen. Bob Kerrey (D) has been talking to top Democrats about possibly running again.
How big of a deal is this? On one hand, it’s easy to underestimate the power of incumbency. Obama Set to Ask For a $1.2 Trillion Increase in The Debt Ceiling

No Troop Parade Imminent as Iraq War Ends

"Normally a fan of anything that would keep my car from getting jacked, this new technology gives me pause. Japanese engineers have designed a high-tech car seat using a series of 360 pressure sensors to make an imprint of your butt and — much like a fingerprint scanner — it uses this data to distinguish an owner from a thief.
Finding out that my butt has a unique "signature" gives me a whole new set of neuroses but I'll forge on.
Developed by the Advanced Institute of Industrial Technology, the unique seat uses the sensors in the seat to collect data, and sends it to an external computer where software creates a roadmap of your butt. If a person other than the owner sits on the seat and the computer doesn't recognize their butt signature the car won't start.
There are a few situations I can imagine throwing this technology for a loop. What if the owner loses or gains weight (of particular interest to me)? What if they wear different clothes? What about valet parking???
The product testing proved promising with a 98 percent rate of success so perhaps they've built in some flexibility or adaptive recognition."

TSA Confiscates Cupcake After Deeming it a 'Security Threat'

Rebecca Hains says she was going through security at the airport in Las Vegas when a TSA agent pulled her aside and said the cupcake frosting was “gel-like” enough to constitute a security risk.
She said she was able to pass through Logan International Airport security with two cupcakes, but she was stopped on the way back when she tried to return with one of them."

Fatter Americans Means Less Fewer Ferry Passengers at One Time

According to documents provided to CBS Atlanta by the U.S. Coast Guard, the final rule for the “Passenger Weight and Inspected Vessel Stability Requirements” amendment goes into effect in March of 2012.
All companies in ownership of such vessels must make all applicable mandatory alterations before that time.
The aforementioned documents state that the final rule was passed to avoid any potential safety issues caused by the excessive strain of larger human cargo.
“The Coast Guard amends its regulations governing the maximum weight and number of passengers that may safely be permitted on board a vessel and other stability regulations, including increasing the Assumed Average Weight per Person … to 185 lb.,” the document states. “Updating regulations to more accurately reflect today’s average weight per person will maintain intended safety levels by accounting for this weight increase.”"

Gingrich (R) Suggests Subpoenaing Justices Over Unpopular Decisions
Not the appropriate way for Congress to show disapproval of a judicial ruling. This has bad idea written all over it.

You read that right. Gingrich proposes to make the folks charged with reviewing acts of Congress more susceptible to congressional influence.
Gingrich says if there is broad opposition to a court decision, Congress should subpoena the ruling judge to defend his or her action in a hearing room.
When asked if Congress could enforce the subpoena by sending the Capitol Police to arrest a judge, Gingrich assented.

Out in New Mexico we find the story of yet another elected official caught up in allegations of malfeasance, and then lashing out in a rather unusual way when they’re called on it. Presented for your consideration, the heartwarming story of state representative Sheryl Williams Stapleton.
A Democratic state legislator in New Mexico lashed out at a Republican colleague, attacking her as acting as a minion of the state’s Republican governor, Susana Martinez, and referring to the governor in questionable terms.
Calling Martinez “the Mexican,” Democratic state Rep. Sheryl Williams Stapleton reportedly shouted at Republican state Rep. Nora Espinoza.
The source of the dispute was an investigative news report that suggested Stapleton had behaved unethically. The piece aired on KRQE-TV in October, reporting that “for years, Stapleton did not take leave from her job as an administrator at the Albuquerque Public Schools system and received pay while attending legislative sessions.” Espinoza commented in the report.
Stapleton shouted at Espinoza during a committee break, according to Capitol Report New Mexico, and accused her of “carrying the Mexican’s water.”
Stapleton told Espinoza that she had been waiting for her and said, “I’m pissed,” later adding, “You said I’m corrupt. Prove it!”
After a while, even I get tired of playing this particular card, but can you imagine if it had been a white male Republican doing this? Referring to the Governor as “the Mexican?” The media would be in full blown, pearl clutching meltdown mode by now. But apparently this remains a “move along… nothing to see here” story."

“The issue is how involved was she in health care discussions between Jan. 8 and March 5. Just as President Nixon had an 18½-minute gap, does Ms. Kagan have a two-month gap?” Mr. Smith said.
Conservative groups have called for Justice Kagan to recuse herself from ruling on the health care case, which the Supreme Court last month said it will consider next year."

Voyager 1 Spacecraft Enters New Region of Our Solar System
Voyager 1 is always in uncharted territory as the farthest man made object from earth, but this kicks it up a notch.

This area is not a place of sightseeing however, as a NASA press release referred to it as a kind of “cosmic purgatory.”
Here, the solar winds ebb somewhat, the magnetic field increases and charged particles from within our solar system – is leaking out into interstellar space. This data has been compiled from information received from Voyager 1 over the course of the last year.
“Voyager tells us now that we’re in a stagnation region in the outermost layer of the bubble around our solar system,” said Ed Stone, Voyager project scientist at the California Institute of Technology in Pasadena. “Voyager is showing that what is outside is pushing back. We shouldn’t have long to wait to find out what the space between stars is really like.”
Despite the fact that Voyager 1 is approximately 11 billion miles (18 billion kilometers) distant from the sun – it still has not encounter interstellar space. The information that scientists have gleaned from the Voyager 1 spacecraft indicates that the spacecraft is still located within the heliosphere. The heliosphere is a “bubble” of charged particles that the sun blows around itself and its retinue of planets."

Obama Administration Approved Large Increase of Legal Gun Sales to Mexico Knowing 25%+ Get Diverted to The Cartels
This looks so bad that they stopped releasing the numbers; which of course makes the whole thing look even worse.

It's a program that some say is worse than the highly-criticized "Fast and Furious" gunrunning scandal, where U.S. agents allowed thousands of weapons to pass from the U.S. to Mexican drug cartels.

Firefighters Let Home Burn to The Ground Because Owners Did Not Pay a $75 Fee ... Again

I don't understand how people in a position to help, let alone those payed to do so, can just stand by and watch.

"The city charges a $75 fee up front for firefighter services throughout the year. Pay the fee and the F.D. will show up and douse the flames that are consuming your home. Don’t pay and the F.D. will show up and … watch it burn. I can understand a policy in which paying the fee gives you priority over a non-payer if your house and their house are on fire simultaneously and the department has to choose which to respond to. And I can understand a policy where paying a small flat fee discharges you from further responsibility for the cost of fighting the fire whereas a non-payer is forced to reimburse the department for all of their expenses afterward. In that case, the fee operates as de facto fire insurance. What I don’t understand is a policy where the F.D. will show up to a blaze but give the non-paying owner no option to get them to fight it. If the owner’s middle class, he’ll likely have some savings with which to reimburse the department for the cost; if the owner’s poor, he could agree to have his wages garnished going forward to partially reimburse them. Either way, the resulting hardship should be enough of a deterrent to encourage people to pay the fee ahead of time."

Pelosi (D) Threatens to Reveal Confidential Information on Gingrich (R) From an Ethics Probe
She is trying to walk the statement back a bit, but it was clear what she was getting at. That sounds like it could be an ethics violation in itself.

S&P Places 15 Euro Zone Countries on Negative Credit Watch

While a credit watch negative typically signals a possible downgrade in no more than three months, S&P said it expects to conclude its review "as soon as possible" following a crucial summit of EU leaders on Friday."

Unemployment Rate Drops to 8.6%
There is some good news here, but not nearly as much as the drop would would have you think. There is a lot of discouraged workers in the drop, but it was not all discouraged workers.

While the official unemployment rate dropped down to 8.6%, that is much more a function of people departing the workforce than people finding a job. The Atlantic managed to screen-cap the major parts of the household data, the basis of the unemployment figures (H/T – Jason Whitman.) The civilian labor force dropped by 315,000, which caused the participation rate to drop to 64.0%, down from 64.2% in October. James Pethokoukis ran the numbers, and declared that if the participation rate were the same as last month, the unemployment rate would be 8.9%. Worse, if it were the same as when President Obama took office, it would be 11%.

The 315,000 seasonal drop in the civilian labor force is almost unprecedented for a November. Since 1982, there have been only 7 times the labor force has dropped between an October and a November, and only 3 times has the drop been even close to this steep. In 2002, 273,000 departed the labor force, in 2008, 332,000 departed the labor force, and in 2009, 227,000 departed the labor force.
Related to that, the number of people not in the labor force, but who want a job now, rose to a seasonally-adjusted 6,595,000, the highest since the first month that statistic was tracked, January 1994. As a percentage of the civilian population, the 2.74% rate is the highest since June 1996.
The final bit of bad news was dug up by Zero Hedge – the average duration of unemployment rose to a new record of 40.9 weeks from the prior 39.4 weeks."

Dow Jumps 490+ Points as Central Banks Provide More Liquidity
Unfortunately, I fear this is just a stop gap measure. While there is some short term relief, it does not solve the underling problems. Without an actual fix the crash is inevitable and the longer it is pushed back the more intense it will be.

The new pricing applies to operations conducted as of Dec. 5, and the authorization of the swap arrangements has been extended to Feb. 13. (Read the FOMC press release here.)

Fitch Changes US Credit Rating Outlook to Negative
Fitch maintained the US's AAA rating, but has put the country on notice we are heading in a bad direction; not that anyone paying attention (and even those who are not) needs the hint.

McCaskill (D) Calls For Probe in to New Smallpox-Vaccine Boondoggle
It is not a bad idea to have maintain the supply of smallpox vaccine around, because even thought it has been eradicated in nature, it is still preserved in a few labs. An accidental or intentional release is a possibility that needs to be defended against. A new vaccine, especially one developed in a no bid contract given to someone with close ties to the administration sounds like a waist of money at best if it is not serious corruption.

Saleh is the fourth Arab leader toppled in the wave of Arab Spring uprisings this year, after longtime dictators fell in Tunisia, Egypt and Libya. The deal gives Saleh immunity from prosecution — contradicting a key demand of Yemen's opposition protesters.
Celebrations erupted in the capital Sanaa as Saleh inked the agreement. Yemenis danced in the streets, set off fireworks and waved flags.
Seated beside Saudi King Abdullah in the Saudi capital Riyadh, Saleh signed the U.S.-backed deal hammered out by his country's powerful Gulf Arab neighbors to transfer power within 30 days to his vice president, Abed Rabbo Mansour Hadi. That will be followed by early presidential elections within 90 days."

Worlds Lightest Material

The "ultralight metallic microlattice" invented by scientists at UC Irvine, HRL Laboratories, and Caltech is described in the Nov. 18 issue of Science.
The new material is 100 times lighter than styrofoam, according to reports. The secret to its lightness is a cellular architecture fabricated from hollow tubes that supports a material structure that is in reality 99.99 percent air, according to the research team that built it.
That means the material's density is less than one-thousandth that of water. And the stuff is pretty resilient as well—researchers said that when squashed to half its height, the material rebounds 98 percent of the way back."

Obama Pardons Turkey ... by 'Executive Action'
Obama maintained the tradition of pardoning a turkey, and used the opportunity to take a jab at those who have been criticizing his end-runs around congress.

"Declaring “we can’t wait to pardon these turkeys,” President Obama Wednesday gave two birds the traditional presidential reprieve from a sentence to be the centerpiece at a Thanksgiving dinner table.
“Some of you may know that recently I’ve been taking a series of executive actions that don’t require congressional approval,” Mr. Obama said. “Well, here’s another one. We can’t wait to pardon these turkeys — literally. Otherwise, they’d end up next to the mashed potatoes and stuffing.”
The president’s daughters, Sasha and Malia, accompanied their father on the North Portico of the White House for the event. As Mr. Obama approached a docile, 45-pound bird named Liberty that had been placed on a table, the president held out his arm and jokingly made the Sign of the Cross over the animal.
“You are hereby pardoned!” the president said.
Liberty and a companion named Peace were raised by students in Willmar, Minn., under the supervision of National Turkey Federation Chairman Richard Huisinga."
