ACORN Files for Bankruptcy

This news did not get a lot of press given what I am guessing was ACORN's intentional timing. The ACORN name was irreparably harmed, but it is doubtful the organization will truly just 'go away'. The same structure will reemerge with a new face.

The pressure and cost of defending ourselves in multiple investigations as a result of the falsified videos has eroded our organization. Appellate Court Rules Congress Can Withhold Funding From ACORN

This overrules a lower court decision I criticized at the time.

"Looks like ACORN lost another round in court last week. New York's 2nd Circuit Court of Appeals has reversed a lower court's decision to re-instate Congressional funding of the Association of Community Organizations for Reform Now (ACORN) ruling that halting funding did not violate the group's rights."

ACORN Employees Tell FBI of Deliberate Election Fraud

This report should not be a surprise to anyone that has been paying attention since the last election cycle. Unless something is done the same thing is going to happen in the next cycle. Instead of the hand wringing something has to be done to stop them.

"The radical activist group ACORN “works” for the Democratic Party and deliberately promotes election fraud, ACORN employees told FBI investigators, according to an FBI document dump Wednesday.

The documents obtained by Judicial Watch, a watchdog group, are FBI investigators’ reports related to the 2007 investigation and arrest of eight St. Louis, Mo., workers from ACORN’s Project Vote affiliate for violation of election laws. All eight employees involved in the scandal later pleaded guilty to voter registration fraud.

Project Vote is ACORN’s voter registration arm. Project Vote continues to operate despite the reported dissolution of the national structure of ACORN.

One employee told the FBI that ACORN headquarters is “wkg [working] for the Democratic Party.”

According to one report, an ACORN employee said the purpose of “[f]raudulent cards” was “[t]o cause confusion on election day to keep polls open longer,” “[t]o allow people who can’t vote to vote,” and “[t]o allow to vote multiple times.”

Another report quotes an employee saying, “Project Vote will pay them whether cards fake or not – whatever they had to do to get the cards was attitude.” Project Vote pays based on the number of cards and “that’s why they were so reckless,” the report says."

ACRON Folds

We knew this was coming, and it is almost here. ACORN will soon be no more; not because they are shutting down, but because they are changing their name. I doubt much else will really change, and expect we may see some merging or strong cooperation between the new entities in the not to distant future.

Federal Judge Says Congress Cutting ACORN's Funding is Unconstitutional

Does this mean that organizations have a constitutional right to continued congressional funding; and by default tax payer money? Maybe not, but is seems now that congress has to jump through a few hoops and give 'acceptable' reasons to why they are cutting the funding. I will have to reread a copy of the constitution to see if I can find that particular provision.

"A federal judge who found it unconstitutional that Congress tried to cut funding to the activist group ACORN has rejected a government request to change her mind and has ordered government agencies to make it clear the funding isn't blocked.

In a written ruling Wednesday, U.S. District Judge Nina Gershon made permanent her conclusion last year that the cutoff of funding was unconstitutional. She ordered all federal agencies to put the word out about it.

The Brooklyn judge said ACORN was punished by Congress without the enactment of administrative processes to decide if money had been handled inappropriately. She said the harm to ACORN's reputation continues because the government never rescinded its advice to withhold funding after it was distributed to "hundreds, if not thousands, of recipients.""

Baltimore Court dismisses ACORN's Lawsuit Against O'Keefe, Giles, And Breitbart

ACORN's Baltimore based lawsuit against O'Keefe, Giles, and Breitbart was dismissed by the court for failure to meet a filing deadline. This is strictly procedural, and not a ruling on the merits. They may refile, but I suspect that they will not.

"Under Maryland Rule 2-507(b), "An action against any defendant who has not been served or over whom the court has not otherwise acquired jurisdiction is subject to dismissal as to that defendant at the expiration of 120 days from the issuance of original process directed to that defendant." That's exactly what the court did March 4, with no apparent notice from the media that covered the filing of the lawsuit. The court's dismissal was without prejudice, meaning that the plaintiffs could theoretically re-file. But, as I argued shortly after it was filed, the lawsuit has substantive flaws that go well beyond the plaintiffs' apparent lack of interest in pursuing it."

Brooklyn DA Finds ACORN Employees Did Not Commit a Crime in Pimp / Tax Evasion / Prostitution Video Scandal

the Brooklyn District Attorney found no criminal conduct from the undercover video which appeared to show ACORN employees offering advice on tax evasion and prostitution/pimping in NY. This does not mean that in the moral sense the employees did not do anything wrong, just that the laws on the books do not cover it. Founding Bloggers thinks the lack of criminality may have more to do with an inappropriate political connection of the DA to ACORN.

ACORN 'Dissolved as a National Structure'

James O'Keefe, Hannah Giles, and Andrew Breitbart may now be able to claim victory over ACORN after their string of victories (Baltimore, Washington DC, New York, San Bernardino California, San Diego California, Philadelphia, Los Angeles take one, Los Angeles take two), calling out Holder to investigate 'or else', Document Dump - San Diego (California)), ACORN as a national organization is no more. This could turn into a Pyrrhic victory if they take there eye off the ball and the 'mini ACORNS' spawn a host of new problems.

Well this is a relief. Now that ACORN has completed their internal investigation and found no pattern of intentional illegal conduct, we can all just move on; or not.

Justice Department Concludes Government Contracts With ACORN From Before Funding Ban Can be Paid

Despite the Senate making it extra clear that they do not want ACORN getting any government funds, just as Congress made it extra clear that ACORN should get no government funds) (see also Johanns Amendment #2355 to H.R. 3288 Passes), the Justice Department has concluded that ACORN can be paid for contracts made before the ban.

I agree with the assessment. It is similar the AIG situation in which the Democrats wanted to make a special tax to remove contractual bonuses which passed in the House. I opined in both posts that we should be frightened at such blatant disregard for contract law. No new contracts can or should be made, but any currently in in effect should be honored. It is interesting how the Democrats seem to be lining up on the opposite side of the issue now. A cynical person might point out that the politicians seem to switch sides based on who it would effect, but I am hopeful that they have just learned they were wrong initially and are now on the right side for good.

ACORN Document Dump - San Diego (California)

With James O'Keefe, Hannah Giles, and Andrew Breitbart putting the squeeze to ACORN (Baltimore, Washington DC, New York, San Bernardino California, San Diego California, Philadelphia, Los Angeles take one, Los Angeles take two), calling out Holder to investigate 'or else', and the other investigations already under way, ACORN has either made a huge error or has intentionally tried to destroy evidence. The key word here is tried because someone saw what ACORN had done, collected the bags of discarded documents, and they ended up in Breitbart's hands. He is referring to this as the "Evidentiary Phase". Basically, if no one else is going to do the job of investigating ACORN, he will. He is off to a good start.

Breitbart to Holder - 'Investigate ACORN or I Will Release More Tapes Right Before The Next Election'

Talk about throwing down the gauntlet. Breitbart called on Holder to investigate ACORN scandal. If he does not, Breitbart promises to release more tapes close the the 2010 election. From most people I would take it as an idle threat, but from Breitbart; well, just look at what he has found/discovered/released this far. I think we will get to find out if Breitbart is bluffing since I doubt Holder will investigate in any meaningful sense, at least by Breitbart's standard.

New Undercover ACORN Video - Los Angeles Take Two

This new Los Angeles video is the eighth in the series of 'sting' videos from James O'Keefe and Hannah Giles if the last Los Angeles tape counts as the seventh; Baltimore, Washington DC, New York, San Bernardino California, San Diego California, Philadelphia, Los Angeles take one, and now Los Angeles take two. Unlike the 'take one' Los Angeles, in this one the ACORN employee is more than willing to help with the underage prostitution ring.

This Los Angeles is the seventh in the series of 'sting' videos from James O'Keefe and Hannah Giles; Baltimore, Washington DC, New York, San Bernardino California, San Diego California, Philadelphia, and now Los Angeles.

The ACORN employee here, Felix Harris, was the only person in the series of undercover videos to balk at the idea of helping facilitate an underage prostitution ring with smuggled in sex slaves. As such he has been labeled the "ACORN Employee of the Year".

ACORN Sues to Restore Federal Funding

I could swear I heard ACORN spokesman go on TV and talk about how they do not need the federal funding so that it did not matter they were being cut off. Guess not so much. I can not imagine this lawsuit winning. Beyond the strong legal arguments an polices that prevent such a suit from prevailing, imagine the consequences should it turn out the other way. Groups suing the federal government to get more tax payer money, basically arguing that they have a right to the people's money. I just do not see it going anywhere.

"A non-profit organization filed a lawsuit against the federal government Thursday morning, seeking to overturn a law stopping the flow of federal funds to ACORN.

The suit, filed in federal court in New York, claims that bills passed by the House and Senate to defund the group qualify as bills of attainder, legislation that unfairly targets one group. Such bills are unconstitutional.

The suit will seek to restore funding and roll-back the ban, which was passed as part of the legislative branch appropriations bill in September.

ACORN claims that the legislation was of “malicious and punitive intent.” The suit also claims Congress violated the Fifth Amendment by skirting due process before doling out the punishment of the funding cut. OMB Director Peter Orszag and Treasury Secretary Timothy Geithner are listed as co-defendants in the suit."

New Undercover ACORN Sting Video, This One From Philadelphia

This clip from Philadelphia makes six if you are counting. I will let you know up front that it is the least engaging one of the bunch. That is because they were forced to cut out the voice of the employee. Still, you can clearly tell that what she was doing, that she should not have been, and that she (and other ACORN supporters) lied about not doing it. This will all become much clearer as you watch for yourself.
