DOJ Announces They Will Not Prosecute Holder Regarding Contempt Vote

Not really a surprise, but nice of them to make it official. This is the reason for the Civil contempt vote.

"We already pretty much knew this was going to happen — Eric Holder is the chief of the Justice Department, for goodness’ sake, it definitely would’ve qualified as a conflict of interest. But, the DOJ went ahead and made it official today, saying that they will not move to prosecute Holder after the House of Reps voted to hold him in criminal contempt of Congress on Thursday:

Good thing the House also voted yesterday to hold the attorney general in civil contempt, which allows them to hire their own counsel and take the case to civil court to seek an order that would require the Obama administration to release the long sought-after documents. If the civil court invalidates Obama’s executive privilege order, criminal proceedings could still be on the table. And if the Obama administration still refused to comply, that’s when impeachment would become a possibility — although I’m convinced that the Oversight Committee would really just rather that they hand over the darn documents already before things get that far. Once again — what are those Justice officials working so hard to hide?

House Votes to Hold Holder in Contempt (Federal and Civil)

Civil is necessary because it is unlikely the DOJ is going to act against the person who runs the DOJ. It is sad that this may be necessary to finally get some answers in the Fast and Furious scandal.

"For the first time ever, the House of Representatives voted Thursday on whether to hold a sitting attorney general in contempt of Congress. Republicans brought the vote to the House floor in an effort to force Attorney General Eric Holder to finally face the music for his willful failure to fully comply with a Congressional subpoena of documents relating to Operation Fast & Furious, the not-botched gunwalking scandal that resulted in the death of a U.S. border patrol agent and countless Mexicans — and face the music Holder did. The House voted 255-67 to hold Eric Holder in contempt.

During the pre-vote debate, Minority Leader Pelosi accused the Republicans of playing “heinous,” “frivolous” political games, and even encouraged the members of her party to walk out on the vote: “I’m very moved by the members of the Congressional Black Caucus who say they are going to walk out on this,” she said on the House floor. “Walk out on this. Perhaps that’s the best way. …I urge my colleagues to vote ‘no’ or not vote.” Her oh-so-rousing call to protest, however, didn’t inspire quite the solidarity she was probably looking for: Over 100 Democrats didn’t vote, but at least 17 Democrats defected and joined Republicans in the contempt charge.

ObamaCare Upheld (5-4)

So much for my predictions last night. Bottom line is that the court rules that Congress does not have the power to mandate through the Commerce Clause or the Necessary and Proper Clause, but does through the tax powers.

This is a bad decision. Unless I am missing something, there is no limiting principle. What is to stop the government from picking a product at random and forcing people to buy it? Did I say 'force', what I mean is make them choose between the product or paying a hefty fine. Did I say 'fine', I meant some sort of selective tax.

Didn't Obama say this was absolutely not a tax. It may now be the biggest tax hikes. Lets see him explain that one in the debates.

ObamaCare Ruling Prediction

With the ObamaCare ruling being handed down tomorrow morning it is time for some last minute predictions.

First prediction ('ripeness') - they are not going to punt on the issue and say they have to wait until people start getting penalized.

Second Prediction (Mandate) - the mandate will be rule unconstitutional by a vote of 6-3. If that is wrong, I would be more surprised if the ruling was 5-4 unconstitutional then 7-2 unconstitutional.

Third Prediction (Severability) - the court will rule 5-4 that there is no severability and strike down the ObamaCare in its entirety. I am not as confident the court will toss the entire law as the mandate being struck down. While I predict a 5-4 toss, if that is off I think it more likely a 5-4 keep then a 6-3 toss.

We will see what happens soon enough.

Obama Claims Executive Privilege on Fast and Furious Docs, House Committee Votes to Hold Holder in Contempt

This story just blew up, and the Main Stream Media have not choice but to cover it now. The Contempt was expected for repeatedly failing to turn over the documents for so long.

The Executive privileged is a bit of a curve ball. If the privileged applied, why wait so long to invoke it? Also, if Obama new nothing about this, how exactly does executive privilege apply? Keeping in mind that Obama was against executive privilege before he was for it (apparently with this invocation), there must be something mighty damaging in those docs for Obama to make this play.

Just 15 minutes before the House Oversight Committee vote against Attorney General Eric Holder takes place, the Department of Justice has asked the White House to insert Executive Privilege for all Operation Fast and Furious documents according to Chairman Issa’s press secretary Becca Watkins.

Fox News is reporting that The Most Transparent Administration Ever has granted Holder’s request and will indeed allow him executive privilege to withhold the documents.

The U.S. Attorney’s office would be the designated prosecutor for the committee if Holder were to be indicted. The attorney general would face a maximum sentence of one year in prison if convicted by a jury.

Boehner just announced that the House will vote next week — unless, of course, O decides to play ball and turn over the documents Issa requested.

"The protesters popping up at Mitt Romney's rallies throughout Michigan Tuesday look like run-of-the-mill grassroots liberals — they wave signs about "the 99 percent," they chant about the Republican's greed, and they describe themselves as a loosely organized coalition of "concerned citizens."

They're also getting paid, two of the protesters and an Obama campaign official told BuzzFeed.

At the candidate's afternoon stop outside a bakery in DeWitt, a group of about 15 protesters stood behind a police barricade, a few of them chanting in support of Obama. Asked why he was protesting, a man dressed in a grim reaper costume pointed a reporter to a pair of "designated representatives" standing in the shade.

"I can't talk, you gotta get one of those people over there to talk to y'all," he said. "They're the ones who can talk to reporters."

Neither of the representatives agreed to give their names, but two protesters said they were getting paid to stand outside of the rally, though their wage is unclear: one said she was getting $7.25 per hour, while another man said they were being paid $17 per hour.

Health Panel Considering Wider Food Ban

"The board hand-picked by Mayor Michael Bloomberg that must approve his ban of selling large sugar-filled drinks at restaurants might be looking at other targets.

The New York City Board of Health showed support for limiting sizes of sugary drinks at a Tuesday meeting in Queens. They agreed to start the process to formalize the large-drink ban by agreeing to start a six-week public comment period.

At the meeting, some of the members of board said they should be considering other limits on high-calorie foods.

One member, Bruce Vladeck, thinks limiting the sizes for movie theater popcorn should be considered.

"The popcorn isn't a whole lot better than the soda," Vladeck said.

Another board member thinks milk drinks should fall under the size limits.

"There are certainly milkshakes and milk-coffee beverages that have monstrous amounts of calories," said board member Dr. Joel Forman.

I have made this joke to my friends before, though it really is not entirely a joke. While we already have pictures of a president apparently smoking pot as a youth, those more or less 'dignified' intentional photos are a far cry from all the angles of people doing dumb stuff caught by their friends camera phones.

The way I have been terming it is that future elections are going to get a lot more interesting, but there is no denying that stupid decisions people are making today will cost them elections (not just for President, but at a local level as well) where those same mistakes would not have made an impact had people of their parents or grandparents generation made them.

2 New Elements Named on Periodic Table

"You can now greet by name two new residents of the period table of elements: Flerovium and Livermorium.

The International Union of Pure and Applied Chemistry officially approved names for the elements – which sit at slot 114 and 116, respectively — on May 31. They have until now gone by the temporary monikers ununquadium and ununhexium.

Both elements are man-made, having first been synthesized at the Joint Institute of Nuclear Research in Dubna, Russia, in 1998 and 2000. The discoveries were confirmed with further work at Lawrence Livermore National Laboratory in California. Suggested names for the two elements have been pending since they were submitted to the IUPAC last year.

The elements were created by smashing calcium ions (with 20 protons) into curium targets (which have 96 protons), combining to form element 116, Livermorium. This element decayed almost immediately into Flerovium, with 114 protons.

In addition to providing new trivia for fifth-graders to memorize, the names honor the labs of their creation. Flerovium was chosen for Flerov Laboratory of Nuclear Reactions in Russia, a facility where many superheavy elements have been produced. The lab is named after physicist Georgiy N. Flerov, who discovered the spontaneous fission of uranium, which led to the USSR’s development of an atomic bomb.

Suicides Outpacing War Deaths for Troops

"The suicide rate among the nation’s active-duty military personnel has spiked this year, eclipsing the number of troops dying in battle and on pace to set a record annual high since the start of the wars in Iraq and Afghanistan more than a decade ago, the Pentagon said Friday.

Suicides have increased even as the United States military has withdrawn from Iraq and stepped up efforts to provide mental health, drug and alcohol, and financial counseling services.

The military said Friday that there had been 154 suicides among active-duty troops through Thursday, a rate of nearly one each day this year. The figures were first reported this week by The Associated Press.

That number represents an 18 percent increase over the 130 active-duty military suicides for the same period in 2011. There were 123 suicides from January to early June in 2010, and 133 during that period in 2009, the Pentagon said.

By contrast, there were 124 American military fatalities in Afghanistan as of June 1 this year, according to the Pentagon.

This morning, the House Judiciary Committee brought Attorney General Eric Holder in to testify regarding the new evidence.

Google Notifying Chinese Users When Search Term Might Trigger China's Internet Blocks

Nice move by Google. It is nice to see them make a move against China's censorship. It is not provocative enough to get them in much trouble, but it gives the user valuable information.

"Google has begun notifying Chinese users when they are using search terms that can trigger China's Internet blocks, in its boldest challenge in two years to Beijing's efforts to restrict online content.

The search giant unveiled on its Chinese site this week a new mechanism that identifies political and other sensitive terms that are censored by Chinese authorities.

For example, when users search for keywords like "carrot" -- which contains the character for Chinese president Hu Jintao's surname -- a yellow dropdown message says: "We've observed that searching for 'hu' in mainland China may temporarily break your connection to Google. This interruption is outside Google's control."

Google says it hopes the alerts "will help improve the search experience in mainland China," where Google's search and other services have been unstable since it entered a public spat with Chinese authorities over censorship over two years ago. A Google spokesman declined to comment further.

Chinese officials do not discuss their Internet restrictions, and its search terms are treated as state secrets. In its post, Google said the trigger terms were identified based on reviews of the outcomes of the 350,000 most popular search queries in China, not an official list.

Unemployment Rate Rises to 8.2%

These are bad numbers all around. Hard to find a silver lining here.

"Jim Pethokoukis called this a “huge miss” on Twitter, and he’s right. Analysts expected the US economy to add 150,000 jobs in May. Instead, we saw only a net gain of 69,000 jobs, and the jobless rate went up slightly to 8.2%:

Nonfarm payroll employment changed little in May (+69,000), and the unemployment rate was essentially unchanged at 8.2 percent, the U.S. Bureau of Labor Statistics reported today. Employment increased in health care, transportation and warehousing, and wholesale trade but declined in construction. Employment was little changed in most other major industries.

The long-term unemployed jumped up by 300,000 as well, while participation ratios rose:

The number of long-term unemployed (those jobless for 27 weeks and over) rose from 5.1 to 5.4 million in May. These individuals accounted for 42.8 percent of the unemployed. (See table A-12.)

The civilian labor force participation rate increased in May by 0.2 percentage point to 63.8 percent, offsetting a decline of the same amount in April. The employment- population ratio edged up to 58.6 percent in May. (See table A-1.)

The number of persons employed part time for economic reasons (sometimes referred to as involuntary part-time workers) edged up to 8.1 million over the month. These individuals were working part time because their hours had been cut back or because they were unable to find a full-time job. (See table A-8.)

In other words, this is an unmitigated flop.

As noted, U-3 (the topline jobless rate) went from 8.1% to 8.2%, the first increase of any kind in that measure since June 2011. The U-6 figure, which comprises all unemployed and marginally attached workers, rose from 14.5% to 14.8%.

"After the 2001 terrorist attacks, California lawmakers sought a way to channel the patriotic fervor and use it to help victims' families and law enforcement. Their answer: Specialty memorial license plates emblazoned with the words, "We Will Never Forget."

Part of the money raised through the sale of the plates was to fund scholarships for children of California residents who perished in the attacks, while the majority _ 85 percent _ was to help fund anti-terrorism efforts.

But a review by The Associated Press of the $15 million collected since lawmakers approved the "California Memorial Scholarship Program" shows only a small fraction of the money went to scholarships. While 40 percent has funded anti-terror training programs, $3 million was raided by Gov. Jerry Brown and his predecessor, Arnold Schwarzenegger, to plug the state's budget deficit.

Millions more have been spent on budget items with little relation to direct threats of terrorism, including livestock diseases and workplace safety.

Moreover, the California Department of Motor Vehicles has been advertising the plates as helping the children of Sept. 11 victims, even though the state stopped funding the scholarship program seven years ago. The specialty plate fund continues to take in $1.5 million a year.

Californians who lost loved ones in the attacks take the raid on the license plate fund as an affront to the memory of those who died.

Warren paints a personal narrative of rising from poverty and being the descendant of the brutalized Cherokee tribe, when in reality neither was true (and irony of ironies, she’s the descendant of someone who likely brutalized the Cherokee).

Her academic work carried forward the victim narrative, as she misleadingly portrayed medical expenses as the primary cause of personal bankruptcy, and used innovative number crunching to portray a “two income trap” which, using a fair analysis of the numbers, actually pointed to marginal tax rates not the evil banks and credit card companies as the primary culprit.

Yet The Boston Herald has stumbled upon what may be Warren’s biggest whopper of all, the claim that she was the first woman in the history of New Jersey to sit for the Bar exam while a nursing mother.
